Supreme Court Brief Filed on behalf of Colorado Communities in Support of NEPA

Following up on the amicus brief we filed in the D.C. Circuit — which contributed to an important legal victory to protect Colorado communities along the Union Pacific line that will receive significant new rail traffic as a result of the proposed Uinta Basin Railway — yesterday, we filed an amicus brief in the U.S. Supreme Court on behalf of a diverse coalition of Colorado communities arguing in favor of preserving the D.C. Circuit’s well-reasoned decision. In particular, the brief highlights the myriad foreseeable impacts of the proposed action that will occur from running trains carrying flammable waxy crude oil through steep, mountainous terrain in Colorado, including a substantial increase in train accidents, ignition of wildlifires in an already fire-prone environment, impacts to the Colorado River and water quality, and the concomitant public health and safety concerns related to these foreseeable effects of the Railway. In addition, the brief highlights the crucial importance of NEPA to Colorado communities and identifies examples of collaborative, durable solutions that have resulted from NEPA’s participatory approach. The oral argument is scheduled for December 10.
